Construction Liens

One of the many things we have learned over the years is the lack of knowledge smaller contractors or even new contractors know about the Notice of Right to Lien (“Notice”) in Oregon. The Oregon Construction Contractors Board (“CCB”) governs and notes the following: (1.) If you provide material only to a residential improvement and your contract is with the owner, you do not need to provide a Notice of Right to Lien to the owner, however you do need to provide one to the lender. However, if you do not have a contract with the owner of a residential improvement, you must provide a Notice of Right to Lien to the owner and the lender.
