Sometimes when parties are contemplating divorce yet aren’t quite sure if that’s the direction they want to go at the time, they enter into a Separation Agreement. A Separation Agreement is like a divorce judgment but doesn’t hold the legal finality that a filed Divorce Judgment does. It’s much more informal than a Divorce Judgment. Additionally, a Separation Agreement does not necessarily need to be filed with the court. There is no fixed time for a Separation Agreement, except that of which the parties agree to.
